These Terms of Use govern your access to and use of www.ldadocumentservices.com, including its pages, forms, educational materials, appointment tools, and links to related services. By accessing or using this website, you agree to these Terms of Use. When you retain LDA Document Services to prepare documents, your services will also be governed by a separate written client contract.

1. Website Use
This website provides general information concerning LDA Document Services, available document-preparation services, and topics relating to California legal documents.
You may use the website only for lawful, personal, and informational purposes.
You must be at least 18 years old and legally capable of entering into a contract to place an order or retain LDA Document Services.
If you do not agree to these Terms of Use, do not use the website.

2. LDA Document Services Is Not a Law Firm
LDA Document Services is not a law firm. Sean Gelt is not an attorney and cannot provide legal advice, represent clients in court, select legal strategies, determine legal rights, or recommend which legal remedy a person should pursue.
A California Legal Document Assistant may prepare legal documents at the specific direction of a self-represented client.
The information available on this website is provided for general educational purposes, is not legal, tax, financial, or investment advice, is not a substitute for advice from a licensed professional, and does not create an attorney-client relationship.
Communications with LDA Document Services are not protected by attorney-client privilege merely because they concern legal documents. Personal information is handled according to our Privacy Policy and applicable confidentiality and recordkeeping obligations.

3. No Attorney-Client Relationship
Using this website, submitting a contact form, scheduling an appointment, sending an email, or speaking with LDA Document Services does not create an attorney-client relationship.
LDA Document Services does not act as your attorney and does not represent you before a court, government agency, financial institution, title company, or any other person or organization.
You remain self-represented unless you separately retain a licensed attorney.

4. Separate Written Client Contract
Website use alone does not retain LDA Document Services.
Before document-preparation services begin, you will receive a separate written client contract describing the documents or services requested, the information and decisions you must provide, fees and payment terms, included and excluded services, revision limits, estimated turnaround, filing or recording responsibilities, cancellation and refund terms, required disclosures, and LDA registration information.
If these Terms of Use conflict with a signed client contract concerning paid document-preparation services, the client contract controls with respect to those services.

5. Client Direction and Responsibility
Documents are prepared from the facts, selections, and instructions you provide.
You are responsible for providing complete and accurate information, confirming that you are authorized to request the documents, reviewing every document before signing or filing it, confirming names, addresses, dates, legal descriptions, asset information, and other factual details, making your own legal and personal decisions, obtaining professional advice when needed, and meeting deadlines unless your written contract expressly assigns a task to LDA Document Services.
LDA Document Services may identify incomplete information, apparent inconsistencies, typographical errors, or missing instructions. That review is not legal analysis and does not guarantee that a document will achieve a particular legal result.

6. Identity Verification
LDA Document Services may require valid government-issued identification before accepting or completing an order, particularly for living trusts, wills, powers of attorney, advance health care directives, trust amendments or restatements, deeds and real-property transfers, certifications of trust, and other documents involving authority, ownership, identity, or signatures.
We may decline, suspend, or cancel a service when identity cannot be reasonably verified, requested documents appear unauthorized, information appears false or materially inconsistent, fraud, forgery, identity theft, coercion, or undue influence is suspected, the person requesting documents lacks apparent authority, or the requested service falls outside the authorized scope of an LDA.
Identification and other sensitive information should be transmitted through the MyCase client portal when instructed.

7. No Guarantee of Outcome
LDA Document Services does not guarantee that a court, recorder, government agency, bank, title company, or other institution will accept a document; that a document will achieve a particular legal, financial, tax, or personal result; that a matter will be completed by a particular date unless expressly agreed in writing; or that laws, forms, fees, filing requirements, or institutional policies will remain unchanged.
LDA Document Services also does not guarantee that use of a document will avoid litigation, probate, conservatorship, taxes, creditor claims, or other proceedings.
A rejection caused by an LDA preparation error will be addressed according to the written client contract. Rejections caused by client information, later changes, third-party requirements, legal issues, or circumstances outside our control may require additional work or fees.

8. When Attorney or Professional Advice Is Needed
You should consult a licensed attorney when you need advice concerning which document or procedure is appropriate; the legal consequences of a proposed decision; contested or disputed matters; rights, remedies, defenses, or litigation strategy; complex property ownership; community and separate property classification; tax planning; creditor or asset-protection planning; Medi-Cal or public-benefits planning; special-needs planning; business succession; blended-family disputes; capacity, coercion, or undue influence; interpretation or validity of an existing legal document; or any other matter requiring legal judgment.
You should consult a qualified tax professional, accountant, financial adviser, title professional, or other licensed professional when the requested decision falls within that professional's expertise.

9. Services We May Decline
LDA Document Services reserves the right to decline or discontinue a requested service when the matter requires legal advice, is contested, involves unclear or inconsistent instructions, lacks required information or identification, appears intended to mislead or defraud, presents a conflict or professional concern, would violate law or LDA registration requirements, remains unpaid, or involves abusive, threatening, or inappropriate communications.
If services have already begun, any refund or balance due will be determined under the signed client contract.

10. Fees and Payment
Prices displayed on the website are informational and may change. The final fee, scope, payment schedule, and refund terms will be stated in the written client contract or invoice.
Unless expressly included in writing, LDA Document Services fees do not include court filing fees, county recording fees, certified-copy fees, notary fees, service-of-process fees, publication fees, mailing or delivery charges, title or escrow fees, financial-institution fees, professional fees, or other third-party charges.
LDA Document Services does not currently operate an automatic-renewal subscription program or automatically charge stored payment methods through this website.

11. Cancellations and Refunds
Cancellation and refund rights for paid services are governed by the written client contract.
Because document preparation may begin shortly after an order is accepted, fees may become earned as work is performed. A client may be responsible for work completed before cancellation, time spent reviewing submitted information, drafting already performed, third-party expenses already incurred, and nonrefundable government or recording fees.
Nothing in these Terms limits a cancellation or refund right that cannot lawfully be waived.

12. MyCase and Other Third-Party Services
We may periodically use third-party platforms, including MyCase, Wix, Google Analytics, Google Ads, Microsoft Bookings, Calendly, Zoom, Microsoft Teams, DocuSign, Google Drive, Dropbox, mapping services, and communication services.
These services are operated by independent providers and may have separate terms and privacy policies. LDA Document Services is not responsible for a third party's independent acts, outages, security practices, data practices, or service availability, except to the extent responsibility cannot lawfully be excluded.
Your use of MyCase or another service does not create an attorney-client relationship.

13. Website Availability and Accuracy
We attempt to maintain useful and accurate website information, but do not guarantee that every page is complete or current, every service is available, every price remains unchanged, every link functions continuously, or the website will be uninterrupted or error-free.
We may modify, suspend, or discontinue website content or functionality without notice. Material changes affecting an existing paid engagement will be handled according to the signed client contract.

14. Educational Materials
Articles, glossaries, guides, frequently asked questions, checklists, videos, and downloadable materials are general educational resources.
They are not individualized recommendations and should not be used as a substitute for legal or professional advice.
You may print or save educational materials for your own personal, noncommercial use. You may not reproduce, sell, license, republish, or distribute them for commercial purposes without written permission.

15. Intellectual Property
Unless otherwise stated, the website design, text, graphics, logos, service descriptions, articles, guides, downloads, and other original content are owned by or licensed to LDA Document Services and are protected by applicable intellectual-property laws.
You may not copy or republish substantial website content, remove copyright or ownership notices, use our name or logo in a misleading manner, sell or commercially distribute our materials, create derivative commercial products from our materials, scrape or systematically extract website content, or impersonate LDA Document Services.
Nothing in these Terms prevents a consumer from making lawful statements or reviews concerning LDA Document Services.

16. Prohibited Conduct
You may not use the website or our services to violate law; commit or facilitate fraud, forgery, identity theft, or deception; impersonate another person; request documents without proper authority; upload malware or harmful code; attempt unauthorized access; interfere with website operation; harvest personal information; submit false or misleading information; infringe intellectual-property or privacy rights; threaten, harass, or abuse staff or others; or use documents for an unlawful purpose.
We may restrict access or decline services when prohibited conduct is suspected.

17. Privacy and Data Security
Our collection and handling of personal information are described in our Privacy Policy.
No website, portal, email system, storage system, or electronic transmission method is completely secure. You are responsible for protecting MyCase credentials, passwords, access links, email accounts, devices, and copies of documents delivered to you.
Notify us promptly if you suspect unauthorized access.

18. Third-Party Links
The website may contain links to third-party websites for convenience or general information. A link does not constitute endorsement or guarantee of a third party's information, products, services, security, privacy practices, accuracy, or availability.
You access third-party websites at your own risk and subject to their terms.

19. Disclaimer of Warranties
To the fullest extent permitted by law, the website and general educational content are provided on an 'as is' and 'as available' basis.
LDA Document Services disclaims implied warranties concerning the website, including warranties of merchantability, fitness for a particular purpose, and noninfringement, to the extent those warranties may lawfully be disclaimed.
This section does not eliminate obligations expressly undertaken in a signed client contract and does not disclaim liability that cannot legally be disclaimed.

20. Limitation of Liability
To the fullest extent permitted by law, LDA Document Services will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from use of, or inability to use, the public website.
This limitation does not apply to liability that cannot legally be limited, obligations expressly stated in a signed client contract, fraud, willful misconduct, or other liability for which a contractual limitation is unenforceable.
For claims arising from paid document-preparation services, the rights and responsibilities of the parties are governed primarily by the signed client contract and applicable law.

21. Indemnification
To the extent permitted by law, you agree to be responsible for claims or losses caused by your unlawful use of the website, materially false information you knowingly provide, lack of authority to request or use a document, infringement of another person's rights, intentional misuse of documents or services, or violation of these Terms.
This provision does not require you to indemnify LDA Document Services for its own negligence, willful misconduct, or violation of law.

22. Dispute Resolution
Before filing a lawsuit or arbitration, each party agrees to make a good-faith effort to resolve the dispute informally.
A written notice of dispute should include the person's name and contact information, a description of the dispute, the service involved, the requested resolution, and relevant supporting documents.

The parties will have 30 days after receipt of the notice to attempt an informal resolution.
If a dispute is not resolved informally, it will be handled in the forum provided by applicable law or in any valid dispute-resolution provision contained in the parties' signed client contract.

23. Governing Law and Venue
These Terms are governed by California law, without regard to conflict-of-law principles.
Subject to any valid dispute-resolution provision in a signed client contract, legal proceedings relating to these Terms or the website must be brought in a court with jurisdiction in San Diego County, California, unless applicable law requires another location.

24. Electronic Communications
By communicating with us electronically, you consent to receive service-related communications by email, text, the MyCase portal, or another method you have authorized.
Electronic communications may include appointment confirmations, intake requests, draft notifications, invoice notices, completion notices, privacy or policy notices, and other communications relating to requested services.
You may withdraw consent to optional marketing messages. Withdrawal does not affect communications necessary to perform an existing service or comply with law.

25. Changes to These Terms
We may update these Terms to reflect changes in website functions, services, business practices, vendors, law, or regulatory guidance.
The revised Terms will be posted with a new Last Updated date. Changes will apply prospectively and will not retroactively alter a signed client contract unless the client agrees or applicable law permits the change.

26. Severability
If a provision of these Terms is held invalid or unenforceable, the remaining provisions will remain effective to the extent permitted by law.

27. No Waiver
Failure to enforce a provision does not waive the right to enforce it later.

28. Entire Agreement for Website Use
These Terms, together with the Privacy Policy and any other policies expressly incorporated into them, constitute the agreement governing use of the public website.
A separate signed client contract governs paid document-preparation services.
